The U.S. Supreme Court will hear oral arguments at 10 AM ET tomorrow (11/10) in the consolidated case of CA v. TX. A decision is expected in the spring of 2021, likely in June.
Due to the pandemic, the Court will hear arguments via an audio call, which will be live streamed by CSPAN and other media outlets. We will also be hosting a call Wednesday (11/11) at 11 AM ET to share our takeaways from the arguments.
With the confirmation of Justice Amy Coney Barrett, ACA supporters are worried that the Court might be more likely to overturn the ACA than previously thought. Justice Ruth Bader Ginsberg had been a reliable vote to uphold the ACA. Barrett had criticized the court’s 2012 ruling to uphold the law in a book review, which Democrats unsuccessfully attempted to use to try to block her confirmation.
